I am a partner with the law firm of Hogan Lovells US LLP (“Hogan Lovells”)3 which maintains an office for the practice of law at 1999 Avenue of the Stars, Suite 1400, Lo 4 Angeles, CA 90067. I am an attorney at law, duly admitted and in good standing to practice i5 the states of California, New York, and New Jersey; the United States District Courts for th6 7 Central, Northern and Southern Districts of California, and Southern and Eastern Districts of Ne 8 York; the United States Court of Appeals for the Second and Ninth Circuits; and the Unite 9 States Supreme Court. 10 2. On June 25, 2020, I submitted a declaration (the “Initial Declaration”) [ECF N11 280], on behalf of Hogan Lovells in support of the Application of the Official Committee 12 Unsecured Creditors for Entry of an Order Authorizing the Retention and Employment of Hoga13 Lovells US LLP as Counsel, Effective as of May 26, 2020 (the “Application”) [ECF No. 279] . 14 15 3. On September 8, 2020, I submitted a supplemental declaration (the “Supplement16 Declaration”) [ECF No. 487] in further support of the Application. 17 4. On July 22, 2020, this Court entered an Order Approving The Application 18 Official Committee of Unsecured Creditors of Wave Computing, Inc. Under 11 U.S.C. §1103 An19 Fed. R. Bankr. P. 2014 And 5002 For An Order Authorizing Retention And Employment 20 Hogan Lovells US LLP As Counsel, Effective As Of May 26, 2020 [ECF No. 355] (the “Retentio21 Order”). 22 23 5. Pursuant to Paragraph 5 of the Retention Order, Hogan Lovells shall provid24 reasonable notice to the Committee, the Debtors and the U.S. Trustee of any increase of Hoga25 Lovells’ hourly rates ten (10) business days prior to filing a fee statement or fee applicatio26 reflecting such increase. 1 shall file any notice of rate increase with the Court, certifying that the Committee has consente2 to such rate increase. 3 6. Accordingly, I submit this second supplemental declaration in further support 4 the Application to provide notice of an increase of Hogan Lovell’s rates effective January 5 2021. Attached hereto as Schedule A is a list of timekeepers who have billed time to th6 7 Committee during the last six months along with their current rates and the increased rate8 effective January 1, 2021. Schedule A reflects increases attributable to each attorney’s increase9 level of experience and to increases in Hogan Lovells’ base rates for attorneys of similar levels 10 experience. 11 7. Each of these rates was and will continue to be consistent with (i) the rates th12 Hogan Lovells charges to other clients of the firm; (ii) the rates charged by comparably skille13 practitioners in the relevant market; and (iii) the rates that Hogan Lovells charges other chapter 114 15 clients, regardless of the geographic location of the chapter 11 case. 16 8. I hereby certify that the Committee has consented to the rate increases set forth o17 Schedule A. 18 9.
