Pursuant to the Plan and Confirmation Order, John D. Cornwell was appointed to serve as the trustee (the “Trustee”) of the VitalPet Liquidating Trust (“Trust”) in the Debtors’ above styled and numbered, jointly-administered chapter 11 bankruptcy cases (collectively, the “Bankruptcy Case”). In addition to the Plan and Confirmation Order, the Trust is governed by that certain Liquidating Trust Agreement (the “Trust Agreement”), dated on or about December 8, 2020. the creditors holding the allowed claims set forth on Exhibit “A” hereto in the amounts set forth therein and in full and complete satisfaction of such allowed claims. No further distributions will be made on account of such claims. PLEASE TAKE FURTHER NOTICE that no distribution has been withheld or reserved under the foregoing distributions as to any creditor asserting a pre-petition promissory note claim on the basis that the claimant has not provided to the Trustee the claimant’s tax identification number as required under the Plan.
