JERNIGAN AT THE UNITED STATES BANKRUTPCY COURT, LOCATED AT 1100 COMMERCE STREET, ROOM 1254, DALLAS, TEXAS This Agenda sets forth items in the order Debtors intent to present to the Court. The status of each is set forth below. 1. Debtors’ Motion for (I) an Order Approving (A) Bid Procedures; (B) The Form and Manner of Notice; (C) The Procedures for Determining Cure Amounts for Executory Contracts and Unexpired Leases; and (II) Entry of an Order Approving (A) The Sale of Substantially All of the Debtors’ Assets Free and Clear of all Liens, Claims, Encumbrances and Interests; and (B) The Assumption and Assignment of Certain Contracts and Unexpired Leases [Docket No. 133] filed by the Debtors. Moving Party: Debtors Nature of the Motion: Approval of the Sale, once or if proceeding Docket Number: 133 Status of the Matter: Debtors’ sought a continuance to February 1, 2021. On Thursday, January 14, 2021, the Court informed Debtors’ that such request would be granted and a form of order has been uploaded for the Court’s consideration. On December 29, 2020, the Debtors filed their Notice of Extension of (I) Milestones Pursuant to Final Order (I) Authorizing Debtors to (A) Use Cash Collateral on a Limited Basis and (B) Obtain Postpetition Financing on Secured, Superpriority Basis, (II) Granting Adequate Protection, and (III) Granting Related Relief and (II) Certain Deadlines under Bid Procedures and Bid Procedures Order [Dkt. No. 383] (“Extension Notice”), memorializing and notify parties-in-interest of the extension agreement between Debtors and the DIP Agent. By the Extension Notice, certain sale procedures related deadlines were extended including without limitation the Bid Deadline, Auction, Sale Objection Deadline, Sale Hearing, and Deadline for Entry of Sale Order. The Bid Deadline has not yet elapsed and the sale process is still ongoing. In accordance with the Extension Notice, Debtors filed their Motion to Continue Motion for (I) an Order Approving (A) Bid Procedures; (B) The Form and Manner of Notice; (C) The Procedures for Determining Cure Amounts for Executory Contracts and Unexpired Leases; and (II) Entry of an Order Approving (A) The Sale of Substantially All of the Debtors’ Assets Free and Clear of all Liens, Claims, Encumbrances and Interests; and (B) The Assumption and Assignment of Certain Contracts and Unexpired Leases [Dkt.
