ELIZABETH DRIVE, KENNER, LOUISIANA TO: Potential Bidders RE: Auction and Sale of 4119 St. Elizabeth Drive, Kenner, Louisiana In re The Roman Catholic Church for the Archdiocese of New Orleans, Case No. 20-10846 (Bankr. E.D. La. 2020) Dear Potential Bidders: On May 27, 2021, The Roman Catholic Church of the Archdiocese of New Orleans (the “Debtor” or “Archdiocese”) filed its Motion for Entry of Orders: (I) Approving Bidding Procedures and Stalking Horse Protections, and (II) Authorizing the Sale of Immovable Property [ECF No. 889] with the United States Bankruptcy Court for the Eastern District of Louisiana (the “Bankruptcy Court”). Pursuant to the Bankruptcy Court’s order dated July 1, 2021 and the Bidding Procedures attached thereto, the property commonly known as 4119 St. Elizabeth Drive, Kenner, Louisiana (the “Property”) will be sold at a public auction pursuant to the terms of the Bidding Procedures. The purpose of this letter is to provide information for your consideration when determining whether to submit a bid for the Property.1 Site Identification The Property is identified as Parcel A, Seton Parc Subdivision, Jefferson Parish, City of Kenner, LA. The Property has a municipal address of 4119 St. Elizabeth Drive, Kenner, LA. Size and Shape The Property is a slightly irregularly shaped parcel. It fronts the west side of St. Elizabeth Drive 318.16’. The Property extends on the south sideline 290’ along St. Blase Drive, turns left on the same street a distance of 180’, and then turns right and extends westerly to the rear property line 461.65’. From the northern boundary of St. Elizabeth Drive, the Property extends on the north sideline 290’ along St. Ann Drive, turns right on the same street a distance of 120’, and then turns left and extends westerly to the rear property line 500.53’. The rear property line is also the western sideline of the entire property (and the western boundary of Jefferson Parish) and measures 619.38’. Based on the measurements contained in the legal description, the total site area is 389,655 square feet, or 8.94525 acres. 1 The information in this letter is largely based upon a Site Data and Analysis prepared by Ron J. Drez, Jr. MAI on August 12, 2019.
4Site Diagram Location and Access The Property fronts several streets: St. Elizabeth Drive on the east, St. Blase Drive on the south, and St. Ann Drive on the north. All are neighborhood, residential streets that have roll-over curbs and storm sewers. The Property is situated in a single-family residential neighborhood. It is “tucked away” in the northwest area of Kenner (East Jefferson Parish), several blocks from the main traffic arteries making it ideal for residential living, as evidenced by the surrounding residential neighborhoods. The major traffic artery that provides access to the Property is Vintage Drive, which lies a couple of blocks south of the Property and traverses in an east-west direction. Vintage Drive intersects Loyola Drive, which is the major north-south traffic artery in the western portion of Kenner. Loyola Drive intersects West Esplanade Avenue and Interstate 10. Topography The Property is level and filled to above street grade, which enables it to drain sufficiently. The adjacent properties are developed to roughly the same elevation. Although soil surveys were not provided to the appraiser, the metropolitan area is known for its soil’s wetness, very slow permeability, and very high shrink-well potential. As a result, a majority of the developments in the area are constructed on pilings. Easements / Encroachments / Private Restrictions The appraiser did not note any adverse servitudes or easements on the legal description. However, upon inspection of the Property, the appraiser noticed what appeared to be some minor encroachments and servitudes encumbering the Property that were considered typical of the neighborhood, such as minor fence encroachments, sidewalks, and utility servitudes. These were not considered to adversely affect the Property’s marketability or utility. However, when
5purchasing or lending on real estate, it is advisable to obtain a complete title abstract by a professional title company, along with a current survey from a reputable local licensed surveyor. NO WARRANTY REGARDING ENCROACHMENTS, EASEMENTS, SERVITUDES, OR PROPERTY TITLE IS EXPRESSED OR IMPLIED HEREIN. Utilities As of the date of the Site Data and Analysis, all public utilities were available to the Property. Those utilities included electricity, natural gas, water, sewerage, telephone, and subsurface drainage. The utilities to the Property are similar to those commonly found in the Jefferson Parish area, and it was opined that they provide sufficient capacity for most uses within the area. Flood Zone According to the Federal Emergency Management Agency (FEMA), a department of the Housing and Urban Development, the Property is situated in Flood Zone “AE” as per the Federal Emergency Management Agency Flood Insurance Rate Map 22051C0135E, dated March 23, 1995. This is a flood hazard area. It was opined that this rating is common throughout the metropolitan area and is not considered to adversely affect the marketability or utility of the Property. For an accurate determination, contact your insurance agent or the National Flood Insurance Program. A copy of a portion of the flood map depicting the Property’s location is included below. 6Improvements The Property is currently improved with several buildings. The improvements are more fully discussed in the Description of Improvements section of this letter. Site Relationship and Conformity Overall, it was opined that the Property is well situated along St. Elizabeth Drive and is considered to be functional for any number of uses allowed under its zoning designation, which is Special Ordinance, R-1. The Property is considered to be typical of those residentially developed parcels situated in the area. As a residential site, the Property conforms well to its similarly zoned surroundings. The neighboring properties are described as follows: North: Single-Family Residential South: Single-Family Residential East: Single-Family Residential West: Levee, Jefferson Parish / St. Charles Parish Line Functional Adequacy The Property’s physical characteristics are considered to be well suited for various uses. The Property is one that is typically found in the residential corridor in which it lies, and no adverse characteristics were noted that would negatively impact its use or marketability.
7Zoning According to the comprehensive zoning ordinance of the City of Kenner, the Property is under the overall zoning designation of “Special Ordinance” with Single Family Residence being the primary zoning code. Although not to be construed as a legal opinion, based on the zoning regulations and the appraiser’s physical inspection of the site, the Property could be developed with any of a number of permitted uses under the regulations of Single Family Residential District and within the deed restrictions set forth in the Draft Purchase Agreement. 8Description of Improvements The Property’s improvements consist of buildings that were previously used in conjunction with the operation of St. Elizabeth Ann Seton School. The gross building area is 45,176 square feet, which is sub-divided into several buildings. The Property’s total site area is 389,655 square feet, or 8.94525 acres. Based upon on-site measurements taken at the time of inspection and review of building sketches provided by the Archdiocese, the appraiser derived the following areas and square footages of the improvements.
