motion, the Court bifurcated the proceedings and held an evidentiary hearing to consider whether the Committee, as it was constituted at that time, adequately represented the unsecured creditor body. On February 8, 2021, the Court issued a Memorandum Opinion and Order wherein the Court granted the primary relief requested in the Motion, finding that the Committee as constituted did not adequately represent unsecured creditors and ordering the United States Trustee to appoint a second official committee comprised of general unsecured creditors. Id. In March 2021, the United States Trustee appointed the Official Committee of Unsecured Commercial Creditors, but did not appoint TMI Trust Company to that committee. [ECF Docs. 772, 792]. TMI Trust Company later contacted the Official Committee of Unsecured Commercial Creditors and joined in an ex officio capacity. [ECF Doc. 854, n.2]. Accordingly, because the primary relief requested in the Motion has been granted, IT IS ORDERED that the remaining alternative relief requested in the Motion is DENIED as MOOT.
