(“UMB”), as Indenture Trustee, for Order (A) Pursuant to Section 1112(b) of the Bankruptcy Code Dismissing Chapter 11 Case or, Alternatively, (B) Modifying the Automatic Stay to Allow UMB to Recover Possession of Collateral filed on February 19, 202 [ECF Dkt. 535] (the “Motion”) and, based on the record of the Preliminary Hearing, determined that an evidentiary hearing is needed. AND, on August 12, 2021 at 12:30 p.m., the Court will hold a further hearing (the “Dismissal Hearing”) to consider the relief sought in the Motion. AND, it is necessary and appropriate to conduct an evidentiary hearing in connection with the Motion. It is hereby ORDERED that: 1. On or before May 28, 2021, the Parties1 shall issue and serve any interrogatories or requests for production of documents with respect to issues relating to the Motion. On or before June 25, 2021, the Parties shall exchange witness lists and any Party who wishes to conduct any depositions of any other Party shall, on or before June 30, 2021, issue notices of such deposition, and any Party who wishes to conduct any depositions of any third party shall, on or before June 30, 2021 issue a notice of such deposition and an appropriate subpoena; provided that any Party seeking to conduct depositions shall consult with the Parties regarding the scheduling of such depositions before issuing notices of deposition. 3. All discovery, including all depositions, relating to the Dismissal Hearing shall be completed on or before July 23, 2021. 4. On or before July 28, 2021 at 12:00 p.m. (ET), the Parties shall file a joint pretrial statement consistent with the form set forth in paragraph 6 below and file a copy with the Court. The joint pretrial statement shall be signed by counsel for all Parties. It is the obligation of UMB’s counsel to initiate, assemble and submit the proposed pretrial statement. UMB’s counsel shall submit a proposed joint pretrial statement to each party’s counsel not less than five (5) business days prior to the deadline for its submission. Counsel are expected to make a diligent effort to prepare a proposed pretrial statement in which will be noted all of the issues on which the parties are in agreement and all of those issues on which they disagree. The proposed pretrial statement shall supersede all pleadings in the case with respect to the positions taken therein. Amendments will be allowed only in exceptional circumstances and to prevent manifest injustice. 5. The joint pretrial statement shall be in the following form: A. Statement of uncontested facts. A statement of the uncontested facts. B. Statement of facts which are in dispute. A statement of the facts in dispute.
