On March 19, 2020, Cigna and LINA, respectively filed the Applications. The Applications assert chapter 11 administrative priority claims (jointly, “Claims”). On April 16, 2020, The LaSalle Group, Inc. and West Houston Memory Care, LLC filed the Objections to Cigna Health and Life Insurance Company’s Applications for Allowance and Payment of Administrative Claim [D.I. 650]. On April 16, 2020, the Liquidating Trustee filed the Liquidating Trustee’s Objections to Cigna Health and Life Insurance Company’s Applications for Allowance and Payment of Administrative Claim [D.I. 651]. On September 16, 2020, this case converted to chapter 7. Subsequently, the Trustee was appointed to be the chapter 7 Trustee. The Trustee represents that there are currently insufficient funds in the LaSalle estate to fund the payment of the claims asserted in the Applications; however, there is a prospect that such funds may become available in the future. The undersigned counsel have periodically conferred regarding the status of the LaSalle estate and the Applications. On May 28, 2021, the Clerk of this Court filed correspondence on the docket requesting that Cigna and LINA [D.I. 812] and the Trustee [D.I. 813], respectively, provide a report on the status of the Applications. In response to the Clerk's correspondence, the Parties jointly state as follows: 1. Cigna and LINA currently intend to pursue the Applications. 2. Cigna, LINA and the Trustee agree that neither the Parties nor the Court should expend resources to adjudicate the Applications unless/until it is determined that there are funds available in the LaSalle estate to pay chapter 11 administrative claims. 3. The Applications should remain open and pending.
