Miller, the chapter 7 trustee (the "Trustee") of the bankruptcy estate (the3 "Estate") of Girardi Keese (the "Debtor"), hereby applies to this Court (the "Application") 4 for an order shortening the time for notice of the hearing on the Chapter 7 Trustee's Thir 5 Motion for Order Approving Stipulations Authorizing Use of Cash Collateral Pursuant to 6 11 U.S.C. § 363 and Federal Rule of Bankruptcy Procedure 4001(d) (the "Motion") 7 [Docket No. 451] (the "Motion"). In support of the Application, the Trustee submits the 8 attached declaration of Elissa D. Miller. 9 10 I. FACTUAL BACKGROUND 11 On February 10, 2021, the Trustee filed her first Motion for Order Approving2 00 12 Stipulations for Use of Cash Collateral and Authorizing Use of Cash Collateral Pursuant 92626  4 445‐1 13 to 11 U.S.C. § 363 and Federal Rule of Bankruptcy Procedure 4001(b) [Docket No. 179] alifornia  •  Fax 71 14 (the "First Cash Collateral Motion"). On February 16, 2021, the Court entered an order a, C 00   es 10 15 granting the First Cash Collateral Motion on an interim basis. See Docket No. 193. See Docket No. 257. 19 On March 30, 2021, the Trustee filed the Chapter 7 Trustee's Second Motion for 20 order Approving Stipulations for use of Cash Collateral and Authorizing Use of Cash 21 Collateral Pursuant to 11 U.S.C. § 363 and Federal Rule of Bankruptcy Procedure 22 4001(d) [Docket No. 287] (the "Second Cash Collateral Motion"). 1 2 II. COMPLIANCE WITH LOCAL BANKRUPTCY RULE 9075-1(b)(2)(A) 3 A. Relief Requested in the Cash Collateral Motion 4 By the Motion, the Trustee seeks approval of stipulations with California Attorney 5 Lending II, Inc. ("CAL II"), Stillwell Madison, LLC ("Stillwell"), Virage SPV 1, LLC 6 ("Virage"), Nano Banc ("Nano"), Joseph Ruigomez, Kathleen Ruigomez, and Jamie 7 Ruigomez (collectively, the "Ruigomez Creditors"), and KCC Class Action Services, LLC8 ("KCC") to use cash collateral from July 1, 2021 through and including September 30, 9 2021 in accordance with the 90-Day Budget (the "Budget") attached to the Motion as 10 Exhibit "1," with expenditures not to exceed 115% of the aggregate "High" expenditures 11 set forth in the Budget, i.e., a 15% variance. This is due in part tC 1 7 el   T 17 lingering costs associated with the move from 1122 Wilshire Boulevard, mediation costs 18 related to the upcoming mediation with ACTS, the offloading and shredding of files, and 19 costs related to an anticipated move from 1126 Wilshire Boulevard such as moving the 20 servers. The Trustee's proposed use of the cash collateral will preserve and enhance th21 value of the Estate. 22 B. The Parties Affected by the Requested Relief 23 Parties who allegedly hold secured claims in the Debtor's cash collateral may be 24 affected by the relief requested in the Motion. In particular, these parties include CAL II, 25 Stillwell, Virage, Nano, the Ruigomez Creditors, and KCC. All of these parties—CAL II, 26 Stillwell, Virage, Nano, the Ruigomez Creditors, and KCC—have consented to the use of27 cash collateral in accordance with the Budget.

CAUSE EXISTS TO HEAR THE MOTION ON SHORTENED TIME 2 Local Bankruptcy Rule 9075-1 permits the Court to shorten the time for notice of a3 hearing "for good cause shown." 4 Good cause exists to shorten notice of the hearing on the Motion. The Trustee is 5 currently in the process of transitioning cases, and needs continued and immediate 6 access to the Debtor's case files and information to do so. Transitioning the cases will 7 allow the Trustee to protect the Debtor's clients and maximize the Debtor's interests in it8 attorneys' fees and costs—the most valuable assets of the Estate. If the Motion is not 9 granted expeditiously, the Trustee will be unnecessarily delayed in paying the costs to 10 preserve the Estate (e.g., the internet services, insurance for the Debtor, the utilities, fee11 for the Debtor's former employees) and the value of the Estate may permanently erode, 2  00 12 irreparably harming the Estate. Most importantly, the Trustee may lose access to the 92626  4 445‐1 13 Debtor's case files and information. 1 DECLARATION OF ELISSA D. MILLER 2 I, Elissa D. Miller, declare as follows: 3 1. I am the duly appointed Chapter 7 Trustee for the bankruptcy estate of 4 Girardi Keese. I am also a partner at SulmeyerKupetz, a Professional Corporation. I 5 know each of the following facts to be true of my own personal knowledge, except as 6 otherwise stated and, if called as a witness, I could and would competently testify with 7 respect thereto.
