FACTUAL BACKGROUND 5 On February 10, 2021, the Trustee filed her first Motion for Order Approving 6 Stipulations for Use of Cash Collateral and Authorizing Use of Cash Collateral Pursuant 7 to 11 U.S.C. § 363 and Federal Rule of Bankruptcy Procedure 4001(b) [Docket No. 179] 8 (the "First Cash Collateral Motion"). On February 16, 2021, the Court entered an order 9 granting the First Cash Collateral Motion on an interim basis. See Docket No. 193. On 10 March 2, 2021, the Court held a final hearing on the First Cash Collateral Motion. The Parties Affected by the Requested Relief 4 Parties who allegedly hold secured claims in the Debtor's cash collateral may be5 affected by the relief requested in the Motion. In particular, these parties include CAL II, 6 Stillwell, Virage, Nano, Jaime, Joseph and Kathleen Ruigomez, and KCC Class Action 7 Services, LLC. CAL II, Virage, Nano and Stillwell have all consented to the use of cash 8 collateral in accordance with the Budget. 9 10 III. CAUSE EXISTS TO HEAR THE MOTION ON SHORTENED TIME 11 Local Bankruptcy Rule 9075-1 permits the Court to shorten the time for notice of a2 0 12 hearing "for good cause shown." 0 92626  4 445‐1 13 Good cause exists to shorten notice of the hearing on the Motion. If the Motion is not 18 granted expeditiously, the Trustee will be unnecessarily delayed in paying the costs to 19 preserve the Estate (e.g., the internet services, insurance for the Debtor, the utilities, fee20 for the Debtor's former employees) and the value of the Estate may permanently erode, 21 irreparably harming the Estate. Most importantly, the Trustee may lose access to the 22 Debtor's case files and information. Currently, the Trustee's authority to use cash 23 collateral expires on March 31, 2021.
