Bank of America filed reservations of rights on July 22, 2021 [D.I. 950 and 949], and the Committee filed its reply on July 23, 2021 [Docket No. 955]. Attached to the Committee’s reply was a proposed form of order approving the relief requested in the Motion (the “Proposed Order”). Hearings on the matter were held on July 26 and August 12, 2021. 3. Consistent with the Court’s ruling at the hearing on the Motion, a revised proposed form of order (the “Revised Order”) resolving the Motion, is attached hereto as Exhibit A, While the Motion was pending, the Committee negotiated with counsel for the Targets, Potter Anderson & Corroon LLP and agreed to further narrow certain aspects of the Proposed Order. The Revised Order reflects those changes. For the convenience of the Court and all parties in interest, a blackline of the Revised Order against the Proposed Order is attached hereto as Exhibit B. 4. The undersigned counsel is available should the Court have any concerns with respect to the foregoing, and respectfully requests that the Court enter the proposed forms of order attached hereto at its earliest convenience.
