On May 14, 2021, Ashby & Geddes, P.A. (“Ashby & Geddes”) as Delaware Counsel to Robert J. Pursuant to the Notice of Second Combined Monthly and Final Fee Application of Ashby & Geddes, P.A. for Compensation for Services Rendered and Reimbursement of Expenses Incurred as Delaware Counsel to the Examiner for (I) the Monthly Period from February 1, 2021 through April 19, 2021, and (II) the Final Period January 8, 2021 through April 19, 2021filed with the Application, objections to the Application were to be filed by no later than June 3, 2021 at 4:00 p.m. (ET) (the “Objection Deadline”). 3. Prior to the Objection Deadline, Ashby & Geddes received informal comments to the relief requested in the Final Application from the Cred Inc. Liquidation Trust (the “Trust”). Other than the informal comments received by the Trust, Ashby & Geddes has received no other informal responses to the Final Application, and no other objection or responsive pleading to the Final Application has appeared on the Court’s docket in these chapter 11 cases. 4. On June 9, 2021, Ashby & Geddes filed the Supplement to Second Combined Monthly and Final Fee Application of Ashby & Geddes, P.A. for Compensation for Services Rendered and Reimbursement of Expenses Incurred as Delaware Counsel to the Examiner for (I) the Monthly Period from February 1, 2021 through April 19, 2021, and (II) the Final Period January 8, 2021 through April 19, 2021 (the “Supplemental Final Application”) [D.I. 817] for additional post-effective date fees and expenses incurred. 5. The Examiner and Ashby & Geddes have agreed to a consensual resolution of the Trust’s informal comments.3 The Examiner and Ashby & Geddes understand that such agreement will be reflected in a proposed form of omnibus order approving all Professional’s fees for the final fee period, and that such form of order will be submitted to the Court prior to the June 17, 2021 hearing. 3 Pursuant to the consensual agreement with the Trust, the Examiner and Ashby & Geddes’ have agreed to a 4% reduction in their original final fee request and supplemental fee request for a total of $36,196.50 in fees owed, resulting in an agreed-upon final fee amount of $34,748.64 (plus $4,255.38 in expenses).
